Returns and exchanges
Returns and exchanges are regulated by:
Retail Trade Rules, approved by Resolution No. 697 of the Government of the Republic of Lithuania on 2001-06-11 (amended by Resolution No. 738 of the Government of the Republic of Lithuania on 2014-07-22, hereinafter - the Rules). Pursuant to the provisions of Rule 25, goods sold to the consumer under distance or off-premises consumer purchase-sale contracts are returned in accordance with the procedure established in Articles 6.228(10) and 6.228(11) of the Civil Code.
When returning goods, the following conditions must be observed:
– returned goods of proper quality must meet the following requirements:
– the returned item must be in its original, undamaged packaging. The requirement to return goods in original packaging does not apply to goods for which the Seller grants a trial period or a trial guarantee. In other cases (money-back guarantees, cases of withdrawal from distance purchase-sale), the requirement for the item to be in its original packaging applies;
– the returned item must be packaged as it was from the factory (correctly arranged packaging materials) so that it can be transported safely. This ensures greater safety for the shipped item. If you have any questions about proper item packaging, you can contact us at the specified contacts for consultation;
– the returned item must not be damaged by the Buyer;
– the returned item must be unused by the Buyer (this requirement does not apply to items for which the Seller grants a trial period or a trial guarantee);
– the returned item must not have lost its commercial appearance (this requirement does not apply to items for which the Seller grants a trial period or a trial guarantee);
– the consumer properties of the returned item must be preserved;
– the returned item must have the same completeness (including gifts and other accessories) as received by the Buyer;
– when returning an item, it is necessary to provide the purchase document for the returned item, and the warranty card (if issued);
The warranty does not apply: *
• to items with mechanical damage or signs of disassembly;
• to items that have been used for purposes other than intended;
• to items whose defects occurred due to the buyer's fault;
• to items with damaged serial stickers;
• to items that have been repaired in an unauthorized service center;
• when a defect occurs due to environmental factors (storm, rain, etc.), Force Majeure (fire, flood), or the impact of accidental external factors (power surge, etc.);
• if a defect occurs due to liquids, objects, etc. entering the device;
• if the buyer does not provide a purchase document (invoice, receipt, leasing agreement);
• to defects caused by the use of non-original accessories;
• to wearing parts (cables, connectors, batteries, holders, etc.);
• to information stored on information carriers;
* The provisions on warranty limitation or non-application are harmonized with Article 6.333, Part 3 of the Civil Code of the Republic of Lithuania.
If a store employee determines that your item has become irreparably defective during the warranty period due to manufacturer's fault (defective item), in such a case, in our store, upon presentation of the item's purchase document, you have the right to request that the defective item be replaced with another identical one or that the money you paid for the item be refunded.
If a store employee determines that your item has become defective during the warranty period due to manufacturer's fault (defective item), but it can be repaired, in such a case you have the right to choose to have the defects of the item removed free of charge (repair the item), to have the defective item replaced with a proper quality item free of charge, to reduce the price of the item, or to unilaterally terminate the purchase-sale contract and demand a refund of the price paid for the item. If you choose the latter two options, you must bring the item to the store along with the purchase document. If you decide to repair the item, inform the store employee serving you.
A buyer who believes their rights have been violated must contact the Seller in writing no later than three months from the date of the violation and state their demands. The Seller must examine the request free of charge no later than within 14 days and provide a detailed, reasoned written answer based on documents. If the problem cannot be resolved, the Buyer has the right to apply to an out-of-court dispute resolution entity (State Consumer Rights Protection Authority, address Vilniaus g. 25, LT-01402 Vilnius, www.vvtat.lt) or to court.
The Buyer must deliver the returned goods to KORALU.LT, at the office address: Sausio 13-osios g. 2, Vilnius, LT-04343
Upon purchasing a defective item, the Buyer has the rights established in the Civil Code of the Republic of Lithuania and the Retail Trade Rules (Resolution No. 697 of the Government of the Republic of Lithuania; 2001-06-11, amended by Resolution No. 738 of the Government of the Republic of Lithuania on 2014-07-22). If the Buyer requests a refund and the Buyer's claim is satisfied, the conditions and procedure for refunding money, exchanging the item for an analogous or other item are established in this document.
IMPORTANT: Bus parcel services or Lithuanian Post do not deliver parcels to the final recipient, so goods must be returned via courier service or delivered in person.
When returning an item, a request must be submitted, detailing the order information: order number, date, item, price, delivery date. The request must indicate the account for the refund. In cases where money is refunded to an account other than the buyer's, it is mandatory to provide a power of attorney issued by the buyer to a third party to receive the refunded money.
Article 6.228(10), paragraph 1 of the Civil Code stipulates that the consumer has the right, without stating a reason and without incurring costs other than those specified in Article 6.228(11) of this Code, to withdraw from a distance contract or an off-premises contract within 14 days, with the exceptions provided in paragraph 2 of this Article. Article 6.228(10), paragraph 6 of the Civil Code stipulates that the consumer notifies the entrepreneur of the withdrawal from the contract either by submitting a clear statement outlining their decision to withdraw from the contract or by submitting a duly completed model contract form (approved by the Government of the Republic of Lithuania).
Calculation of the return period for goods:
The consumer has the right to withdraw from a distance contract within 14 days from the moment they receive the ordered goods.
Article 6.228(10), paragraph 3, point 2 of the Civil Code states that the 14-day period for withdrawal from a distance contract expires after fourteen days when the purchase-sale contract is concluded – from the day on which the consumer or a person indicated by the consumer, other than the carrier, receives the ordered item or:
a) if the consumer ordered more than one item with a single order and the items are delivered separately – from the day on which the consumer or a person indicated by the consumer, other than the carrier, receives the last item;
b) if the item is delivered in different batches or parts – from the day on which the consumer or a person indicated by the consumer, other than the carrier, receives the last batch or part.
Regarding the coverage of shipping and return costs for goods:
Regarding commercial appearance:
In accordance with the procedure established by law, the Seller undertakes to refund the money within 14 days after the authorized service confirms that the item is in proper condition, i.e., no damages, alterations, replaced parts are found, the serial number of the purchased and returned item matches, etc.
Goods can be returned during business hours: Mon-Fri, 9 AM - 5 PM. Koralu.lt unilaterally has the right to deduct the amount of the additional discount granted from the amount refunded to the customer, if the customer used an additional offer discount and later cancelled (returned) at least one quality item from the offer to which the discount was applied.
In cases where the reason for returning the goods is improper quality, the seller undertakes to replace the improper quality item with a proper quality item at its own expense or to refund the money paid for the item. Improper quality goods are replaced or refunded in accordance with the provisions of the Civil Code and the Retail Trade Rules.
If, during the warranty period, a defective item purchased by the customer is replaced with a new item of proper quality, the remaining warranty period applies to the replaced item, i.e., the warranty period is not extended.
